Gear Cover Guarantee Terms and Conditions

1. SUMMARY

This overview contains important information about the GoGet Gear Cover Guarantee as it relates to Your rights, obligations, benefits, limitations and exclusions. GoGet Adventure facilitates the listing and rental of a vast array of Gear via Our online platform/site to enable and encourage collaborative consumption and sharing in a safe, user-friendly environment - www.goget.co.za
By listing Gear, renting Gear or by registering or using the site, You (or any other legal entity that You represent) acknowledge and confirm that You have read, understood and agree to be bound by the GoGet Gear Cover Guarantee terms and conditions. Furthermore, You agree to comply with all requirements and conditions set herein, and others as posted on the site from time to time, as well as act in good faith towards all parties and exercise due care as can be reasonably expected in order to be eligible and benefit from any cover under the GoGet Gear Cover Guarantee. Any degree of non-compliance with the above as determined by Us or those that represent Us will invalidate the cover provided.
YOU MUST COMPLY WITH ALL OF THE REQUIREMENTS AND CONDITIONS IN THIS GOGET GEAR COVER GUARANTEE IN ORDER TO BE ELIGIBLE TO RECEIVE ANY PAYMENTS FOR COVERED LOSSES (SEE DEFINITION BELOW). YOUR FAILURE TO FULLY COMPLY WILL PREVENT YOUR RECOVERY FOR ANY COVERED LOSSES.

2. HOW IT WORKS

The Gear rented by transacting via our site, will automatically be covered by the GoGet Gear Cover Guarantee.

A "Renter" means a Member who has completed GoGet Adventures' account registration process, has agreed to the GoGet Adventure Terms of Service and Terms of Use, and who books their rental of the Gear using the platform as provided by GoGet.

An "Owner" means a Member who has completed GoGet Adventures' account registration process, has agreed to the GoGet Terms of Service and Terms of Use, and who lists his/her Gear on the platform as provided by GoGet.

3. WHAT IS COVERED

"Covered Losses" means and is limited to direct physical loss, theft or physical damage to Covered Gear which is subject to the Rental whist in the care, custody and control of the Renter. Covered Losses do not include any losses or damage described under "What is Excluded" section below:
3.1.
Land, Air & Water Gear (excluding motorbikes):

For any loss of or damage to the whole or part of the Gear as is the subject of the rental agreement whether by any accident or misfortune.
-
Cover is available anywhere in the world.
3.2.
Motorbikes (but excluding Superbikes)
-
We cover all manner of motorbikes such as (but not limited to) cruisers, adventure, off-road and quadbikes. We provide comprehensive cover which includes cover for various damage such fire, hail, accident including theft and hi-jack up to the maximum value of the item as noted on the rental agreement or the item retail value, whichever is the lesser.
-
We will cover You against loss of or damage to the vehicle which is the subject of the Rental, and its permanently fitted accessories (if the rental value is adequate).
-
We will at our own option repair, replace the rental vehicle or its permanently fitted accessories, or may pay in cash the amount of the loss, theft or damage.
-
Third Party Liability cover is also covered for road-going, licensed motorbikes up to the maximum value of R1,000,000.
-
Cover is available whilst in the following territories; Republic of South Africa, Botswana, Kenya, Lesotho, Malawi, Mozambique, Namibia, Swaziland, Tanzania, Uganda, Zambia and Zimbabwe.
Cover limitations and exclusions are noted below under in "WHAT IS EXCLUDED/NOT COVERED" section. All repairs and replacements will have the relevant co-payments that are applicable as detailed in "GOGET GEAR DAMAGE CO-PAYMENT" section. Gear is covered for up to the maximum value of the item as noted on the rental agreement or the item replacement/fair market value, whichever is the lesser.

4. WHAT IS EXCLUDED/NOT COVERED

The GoGet Gear Cover Guarantee provides protection for up to the limit stated on the Rental Agreement (subject to the conditions laid out below) to an Owner for loss, theft or damage to the Gear subject to the exclusions listed below.
In simple terms, we don't cover any losses, damages, cost or expense of whatsoever nature, directly or indirectly, caused by or resulting from any of the following, regardless of any other cause or event contributing thereto:

Any public liability to a Third Party for injury, death or property damage (except for that motor liability that is specifically noted under the motorcycle cover) of whatever nature. For example; General & Public Liability, Water-skiers Liability, Motor Third Party Liability is not covered).

The GoGet Gear Cover Guarantee is not insurance and does not intend on providing any Liability cover which is traditionally provided for under a Homeowners or Householders insurance policy. Make sure You review and understand the terms of Your insurance policy and what it covers and doesn't cover.

Consequential damage of any nature.
-
Damage resulting from cleaning, repair, dyeing, bleaching, alteration or restoration.
-
Manufacturer failure or inherent vice or defect. That is, anything that may be covered by a manufacturer's warranty.
-
Wear, tear or gradual deterioration. This generally means any fault which would occur under normal use and conditions.
-
Damage as a result of vermin, insects, damp, mildew, rust or similar events.
-
Pre-existing damage e.g. damage that occurred before handover to the Renter.
-
Theft of anything from a vehicle whist Gear is not locked away in a concealed compartment such as a cubby-hole or boot.
-
Fraud or dishonesty of whatever nature.
-
Any hostile act or act of war, terrorism, insurrection or rebellion, actual or threatened malicious use of poisonous biological or chemical materials, nuclear reaction or radiation or radioactive contamination.
-
Seizure, detention or destruction under quarantine or custom regulation, sanction by order of any governmental or public authority, contraband, or illegal transportation or trade.
-
Any dishonest act by the Owner.
-
Mechanical, electronic or electrical breakdown, failure, breakage or derangement unless caused by an accident.
-
Loss of or damage to any Gear not noted in the rental agreement (including accessories not specifically noted).
-
Costs associated to loss, theft, damage to Superbikes or any related liability claims.
-
Any Loss that does not occur during the rental period i.e. before handover by the Owner or after return to the Owner or expiry of the rental period, whichever occurs first.
-
Any Loss resulting from the use of the Gear/item for a purpose other than the purpose that it is intended to be used for with the knowledge or permission of the Owner.
-
Any loss or damage that is covered under any insurance policy that is in place in favour of the Owner.
-
Any Loss arising from defective design, workmanship or construction, or material or lack of maintenance by the Owner/Renter.
-
Excluded property as noted by Us from time to time.
-
Cover does not apply when Renters break the law i.e. they do not adhere to the basic conditions of the use of the Gear as is required by law. For example (not limited to); riding a motorbike without the necessary license.
-
Costs associated to injury or death of a Renter or a Third Party whilst the Renter is in possession of Gear.
-
Any cost for loss of fees, earnings/income that may otherwise have been earned by an Owner had the Gear not been damaged, lost, stolen. including confirmed bookings already made by other Renters.

5. GOGET GEAR DAMAGE CO-PAYMENT [RELEVANT FOR RENTER]

The GoGet Gear Damage Co-Payment is paid over by the Renter in the form of a security deposit when the rental payment is processed. In the event of loss or damage to Gear during the Period of the Cover, the co-payment due by the Renter towards the cost of repair/replacement is applied and will be set-off from the security deposit due to the Renter as follows:

For Gear valued at less than R5,000 You will be liable for 10% of the value of the item.
-
For Gear valued at more than R5,000 You will be liable for 5% of the value of the item.
-
For the processing of a claim by GoGet, a once-off Processing Administration Fee will be levied, this fee is not payable in addition to the security deposit paid by the Renter but will be deducted.
-
On the finalization of a claim, any amount in excess of the cost of a repair and up to the value of the GoGet Gear Damage Co-Payment amount as paid over by the Renter You will be retained by GoGet Adventure to the maximum of R500.00 as a Processing Administration Fee.

6. PERIOD OF COVER

The GoGet Gear Cover shall be for the Rental Period and is intended to cover the Gear whilst in possession of the Renter during the Rental Period. For clarity purposes:

The rental of the Gear will commence on the Commencement Date and continue until the Return Date ("Rental Period");
-
Where the Renter wishes to extend the Rental Period the Renter shall utilize its GoGet Service Account and, if available, request a new Rental Period for the Gear. Any extended period shall be dealt with as a new Rental Period under a new Rental Agreement;
-
Where Gear has not been returned to the Owner on the agreed Return Date the Rental Period will automatically be extended to the date on which the Renter will return the Gear to the Owner.
Important: the GoGet Gear Cover Guarantee is not intended to provide cover for Gear whilst in the possession of the Owner.

7. COVER TERMINATE/EXPIRY

Cover for the Gear which is the subject of the rental will terminate on the happening of any one of the following events:
1.
After a claim has been paid.
2.
Once the Rental Period has expired.
3.
the Gear has been handed over to the Owner by the Renter, regardless of whether the Rental Period has already expired.
4.
If any of the conditions of the GoGet Gear Cover Guarantee are breached by the Owner/Renter.
5.
Should the Owner/Renter not comply with its lawful and civil obligations. It is the combined responsibility of the Owner and Renter of the Gear to ensure that all legal requirements specific to the goods being rented, whilst making use of the GoGet Adventure platform, are complied with as it relates to the proper use, transport, storage of the equipment.
The Owner/Renter is to ensure that all the necessary permits, operating/driving/skippers licenses, roadworthy/seaworthy certificates, due care, legal requirements or any other obligation of whatever nature are complied with to ensure the proper and lawful use of the gear which is subject to the rental are complied with. We recommend that photos are taken of said permits, licenses or certificates for record purposes.
Important: Should the GoGet Gear Cover Guarantee be invalidated for whatever reason; the Renter will still be liable for any damages or losses to the Gear. The Owner/Renter will not in any way whatsoever, be able to hold GoGet Adventure liable for whatsoever reason. As such, any damages, losses, liability incurred shall be for the account of the Owner/Renter as any approach on GoGet Adventure under the benefits provided by the GoGet Gear Cover Guarantee will be null and void. Accordingly, the Renter and Owner will be responsible for all liability, associated costs relating to loss, damage, injury, death, liability of whatever nature or howsoever arising.

8. REPORTING OF A CLAIM

8.1.
For Renters:
When You collect/hand over the Gear from/to the Owner, take photographs of the condition of the Gear. This way, any allegation that an Owner may make regarding damage You may have caused to their Gear may be refuted by You. BUT…if something does happen whilst gear is still in Your possession, follow the following steps and we will assist You.
STEP 1: Immediately report it to:
  • The Owner of the Gear via telephone, sms or email.
  • Via your login on the GoGet Adventure website www.goget.co.za (message system). We recommend that the parties use this smart message system that will capture all correspondence accordingly.
STEP 2: If required, call the South African Police Service (SAPS) or Traffic Police.
STEP 3: Reporting:
When reporting an incident/loss/damage to the Owner, include:
  • Photographs of the damage and scene
  • Detailed description of incident
  • All other relevant information:
    • Time and date
    • Place (street names) or nearest landmark
    • Names and contact information of witnesses or involved parties
    • Third Party information (insurance policy information, photos of their licenses, license plates, license disc, vehicle.)
    • Police case number in the event of a crime or road/water accident.
STEP 4: Assessment:
The damage/loss will be assessed by our team and You will be advised:
  • As to the outcome of the assessment
  • If the damage/loss falls within the parameters of the GoGet Gear Cover Guarantee
  • If all the terms and conditions of the GoGet Gear Cover Guarantee were complied with
  • As to whether the damage/loss is covered
  • The value of the benefit paid to the Owner due to the damage/loss whilst in Your possession
STEP 5: GoGet Gear Damage Co-Payment processed:
  • The GoGet Gear Damage Co-Payment paid over by You in the form of a security deposit when the rental payment was processed will be withheld by GoGet Adventure. You will recall that the GoGet Gear Damage Co-Payment applied and was payable by You as follows:
    • For Gear valued at less than R5,000 You will be liable for 10% of the value of the item;
    • For Gear valued at more than R5,000 You will be liable for 5% of the value of the item;
  • On finalization of a claim, any amount in excess of the cost of a repair and up to the value of the GoGet Gear Damage Co-Payment amount as paid over by You will be retained by GoGet Adventure to the maximum of R500.00 as a Processing Administration Fee.
  • Should the value of the loss/damage be of a minor nature (i.e. scratches, small dents, loss of accessories) You may choose, together with the Owner, to resolve the issue without alerting GoGet Adventure in order to save valuable time, cost and effort.
Our agents will take the matter up with the Owner. Note that they may choose to make further contact with You if it is necessary to finalize the claims process.
8.2.
For Owners:
Before and after Gear changes hands, take diligent care to carefully inspect the Gear and take photographs of the condition of the Gear. This way, there can be no dispute by the Renter as to how, when and in who's possession the damage occurred. If You do discover damage, immediately follow the steps below and we will assist You. Only the Owner can submit a claim under the GoGet Gear Cover Guarantee.
STEP 1: Immediately report it to GoGet Adventure via our website www.goget.co.za by completing and submitting the information as requested on the prescribed claim form. Please ensure that the information is accurate. We or our nominee will reply on this information when submitting your claim to the relevant party.
STEP 2: If required, call the South African Police Service (SAPS) or Traffic Police.
STEP 3: Reporting:
When reporting an incident/loss/damage via website www.goget.co.za, (the prescribed claim form online) include:
  • Photographs of the damage and scene
  • Detailed description of incident
  • All other relevant information:
    • Time and date
    • Place (street names) or nearest landmark
    • Names and contact information of witnesses or involved parties
    • Third Party information (insurance policy information, photos of their licenses, license plates, license disc, vehicle description or other information that will assist in managing a claim)
    • Police case number in the event of a crime or road/water accident.
    • Declaration as to whether there is any insurance policy owned by you that also covers the Gear being claimed for by you.
STEP 4: Submit a quote:
  • In the case of damage; a damage report as well as 3 repair quotes are required
  • In the case of theft/loss; 3 replacement quotes are required
  • Note that in the case of repair or replacement, we reserve the right to appoint an independent assessor of our choice to determine the appropriate level of compensation due.
STEP 5: Assessment: The damage/loss will be assessed by our team and You will be advised:
  • As to the outcome of the assessment
  • If the damage/loss falls within the parameters of the GoGet Gear Cover Guarantee
  • If all the terms and conditions of the GoGet Gear Cover Guarantee were complied with
  • As to whether the damage/loss is covered
  • The value of the benefit due to You
  • The GoGet Gear Cover Guarantee paid over by the Renter in the form of a security deposit when the rental payment was processed will be withheld by GoGet. You will recall that the GoGet Gear Damage Co-Payment applied and was payable by the Renter as follows:
    • For Gear valued at less than R5,000 You will be liable for 10% of the value of the item;
    • For Gear valued at more than R5,000 You will be liable for 5% of the value of the item.
  • The Renter will be liable for any amount in excess of the cost of a repair and up to the value of the GoGet Gear Damage Co-Payment amount as paid over by them to the maximum of R500.00 as a Processing Administration Fee.
  • Should the value of the loss/damage be of a minor nature (including but not limited to scratches, small dents, loss of accessories) You may choose, together with the Renter, to resolve the issue without alerting us in order to save valuable time, cost and effort.
  • However, please note that should You choose not to report the incident to us within the required 48 hour notice period as detailed below, and the cost of repair/replacement is higher than anticipated, You will not be able to register a claim against the GoGet Gear Cover Guarantee.
Our agents may choose to make further contact with You or the Renter as required in order to finalize the process. GoGet Adventure, or our nominated party, reserve the right to approach any Third Party who was at fault for recovery against them or their own insurer.
The Owner will have up to a maximum of 48 hours after the Rental Period has lapsed in order to report a damage to/loss of the Gear. Should the damage/loss not be reported via our website, the benefits provided under the GoGet Gear Cover Guarantee will expire.

9. OWNER OBLIGATIONS

In order to maintain Your eligibility for the cover benefits, You must fully comply with the terms and conditions of the GoGet Gear Cover Guarantee. Your failure to fully comply will prevent Your recovery from Us for any covered losses. In all cases, the onus remains on You to prove Your loss or any damage.

Covered Losses for which You seek payment must be covered in terms of the GoGet Gear Cover Guarantee terms and conditions, and GoGet Adventure will, at its sole discretion make its payment of benefits under this Cover Guarantee once the incident has been assessed by our Administrator and it is confirmed that any loss/damage is covered.

Provide all information required as well as cooperate in every way as is required of You to resolve a matter. Including providing access to review all communications between You and the Renter, the submitting/signing of any documents, responding to any reasonable requests timeously, appearing as a witness in any court/arbitration. Failure to do so will cause any benefits to be forfeited by You.

You must take reasonable steps to ensure that the Renter of Your Gear is compliant with any obligation they may have in order to properly and lawfully make use of Your Gear. For example, being in possession of a valid license if the Renter wants to rent your motorbike to drive on the road.
-
On receiving the Gear back from the Renter, You must inspect the Gear to determine whether there are any physical losses or damages to any Covered Gear and immediately document, photograph and report any such damage or loss via the claims portal on the GoGet Adventure website.

For all claims lodged by You which are as a result of a crime, a road accident and for which You would ordinarily have an obligation to report the incident to You local Police Services it is incumbent on You to ensure that the matter is reported within 24 hours and that You obtain a police case number.

As is reasonably acceptable to Us, You must provide Us with proof of ownership of, or proof of Your own financial interest or legal responsibility for the Covered Gear. This may be in the form of receipts, photographs, videos, contracts, documents of valuation or the like.

You must lodge a claim as per the claims guidelines as detailed in the above section "REPORTING OF A CLAIM".

You must protect damaged Gear from further loss or damages and permit and, if required by Us, make available for further inspection by our assessor at all reasonable times. Failure to allow access to damaged Gear for our assessment as and when we reasonably require will invalidate any benefits under the Cover provided by us.

Once You have claimed for an incident under the GoGet Gear Cover Guarantee and payment processed by us; the matter relating to that specific incident will be considered finalized. Accordingly, You will not be permitted to claim any further compensation for that specific incident.

All rights of ownership for damaged property replaced by Us will transfer to Us on the pay out of any claim. We may choose to exercise this right at our own discretion, if we choose not to exercise this right the onus for disposal in a responsible and legal manner relating to damaged Gear will remain Yours.

Furthermore, we may elect at our own discretion to allow You to retain full right of possession of the damaged Gear. If the damaged Gear can be sold, the proceeds from the sale. will reduce the payment due to You by Us proportionally.

You agree to assign to GoGet Adventure any rights, remedies or recourse You may have to recover any amounts from any Third Party.
-
to refund to Us any amounts that are mistakenly paid to You by Us with respect to the GoGet Gear Cover Guarantee regardless of whether the claim is in-process, approved or declined.

The decision regarding the outcome of all matters, including but not limited to, the amount/value, approval/rejection, handling and appointing of Third Party suppliers/assessors for an opinion regarding incidents/claims rests with GoGet Adventure (or our nominated representative/s) and is final and binding.

You will have no further claim against Us or any additional benefits from GoGet Adventure other than those noted herein. The onus rests on You to ensure that You purchase a separate insurance policy to the extent You desire additional protection beyond the coverage noted herein. This so that You have access to cover for losses caused by Renters in the event of Your not being able to access benefits under the GoGet Gear Cover Guarantee provided by GoGet Adventure for whatever reason.

10. MODIFICATION OR TERMINATION OF GOGET GEAR COVER GUARANTEE TERMS AND CONDITIONS

We maintain the right, without incurring any liability of whatever nature and howsoever arising, to modify or terminate the GoGet Gear Cover Guarantee, at any time, at our sole discretion by giving immediate notice of our intention to do so. If GoGet modifies these terms and conditions, we will post the modification on the GoGet Services (our sites).

If GoGet modifies or terminates this GoGet Gear Cover Guarantee in accordance with the foregoing, GoGet will process all GoGet Gear Cover Guarantee payment request that you file prior to or as of the effective date of such modification or termination unless such processing is prohibited by law, regulation, ordinance, order, or decree of any governmental or other authority.

11. SUBROGATION

GoGet and/or GoGet's insurer have the right to subrogate against any person or entity whatsoever who allegedly is responsible for causing the losses or damages in question, even if that person or entity is you. Further, you hereby agree that, with respect to any payments made under the GoGet Gear Cover Guarantee by, or on behalf of, GoGet, you will assist in and cooperate fully with GoGet regarding any and all efforts at subrogation.

12. YOU ACKNOWLEDGE AND AGREE THAT

The GoGet Gear Cover Guarantee is not intended to be an insurance policy or constitute an insurance contract and is not intended to replace any insurance cover that can be obtained by You.

We do not purport to be an Authorized Financial Services Provider as approved by the South African Financial Services Board nor do we provide Financial Advice or Intermediary Services.

The GoGet Gear Cover Guarantee is a guarantee of obligations of a Renter to the Owner.
-
GoGet provides the Owner with the GoGet Gear Cover Guarantee benefits described herein solely for the purpose of promoting use of the GoGet Services by building customer loyalty and strengthening customer confidence as to use of the GoGet Services.

The benefits provided under this GoGet Gear Cover Guarantee terms and conditions are solely as set forth above and such benefits are not assignable or transferable by you, including without limitation any transfer or assignment by operation of law or in connection with your divorce or death.

GoGet and/or its insurer reserve the right to independently investigate (or to have independently investigated) at our sole discretion and expense, the facts and circumstances of a claim / payment request set forth in this GoGet Gear Cover Guarantee that you file with GoGet, notwithstanding your delivery of all information and materials that you are required to provide GoGet in order to comply with the conditions set forth in the GoGet Gear Cover Guarantee.

You acknowledge and agree that if you make a claim under this GoGet Gear Cover Guarantee, you give GoGet consent to review all communications between you and the allegedly Renter via the GoGet Services and all documents you may have uploaded in terms of the Gear.

GoGet reserves the right, at any time, to offset or deduct from the amounts payable or paid by GoGet to you under this GoGet Gear Cover Guarantee terms and conditions, any amounts that it may have in its possession, or to subsequently collect, from any other person or entity who is obligated to compensate you for losses or damages.

If we are advised that any Gear is the subject of a valid Credit Agreement as defined in the National Credit Act (Act 34 of 2005), You agree that we may, at our own discretion, instruct that payment be made first to the title holder shown in the agreement up to the outstanding amount, limited to the maximum amount payable. If the outstanding amount is less than the maximum amount payable We will pay the balance to You.
